Plan for Health Data Collection on LGBT
HHS is seeking public comments on draft standards for data collection on race, ethnicity, sex, primary language and disability status, as required by Section 4302 of the Affordable Care Act [PDF | 1.6 MB].

The law requires that data collection standards for these measures be used, to the extent practicable, in all national population health surveys. They will apply to self-reported information only. The law also requires any data standards published by HHS comply with standards created by the Office of Management and Budget (OMB).

Public comments will be accepted until August 1.

Public Comments Requested

Each respondent is requested to preface his or her comments by identifying those standards on which they are commenting and whether they also are providing general comments.

The submission of comments in response to this notice should not exceed 5 pages, not including appendices and supplemental documents. Any information you submit will be made public. Please do not send proprietary, commercial, financial, business confidential, trade secret or personal information that you do not wish to be made public.

How To Comment

You may submit comments in one of three ways.
  1. Electronically, you may submit comments to http://www.regulations.gov. Enter docket ID number HHS-OMH-2011-0013 in the "Enter Keyword or ID" field and click on "Search." On the next web page, click on the "Submit a Comment" action and follow the instructions.
  2. By regular mail. You may mail written comments to the following address only: Office of Minority Health Resource Center, Attention: Affordable Care Act Section 4302 Data Standard Comments, P.O. Box 37337, Washington, DC 20013-73337. Please allow sufficient time for mailed comments to be received before close of the comment period.
  3. By express, overnight mail or courier. You may send or deliver written comments to the following address: Office of Minority Health Resource Center, Attention: Affordable Care Act Section 4302 Data Standard Comments, 1101 Wootton Parkway, Suite 650, Rockville, MD 20852. If you are delivering by courier, please call (800) 444-6472 in advance to schedule your delivery.

How We Will Use Your Comments

HHS will review the public comments for consideration and possible incorporation into a final set of data collection standards for use in HHS population health surveys.
